U.S. CBP Upholds Innoscience in Patent Litigation vs. EPC, Allowing Innoscience GaN Shipments to U.S.

Suzhou, China, March 13th, 2026 – Innoscience (HKEX:02577.HK) the world leader in 8-inch GaN-on-Si high-performance low-cost manufacturing, announced that the U.S. Customs and Border Protection (CBP) concluded an inter-parties proceeding between Innoscience and Efficient Power Conversion (EPC), confirming that Innoscience’s new-generation products are not subject to the Limited Exclusion Order (LEO) issued in the U.S. International Trade Commission (ITC) 337-TA-1366 ruling. This decisive action by the U.S. CBP clears the way for U.S. importation of Innoscience’s high-efficiency high power density GaN products, driving innovation for AI datacenters, Robotics, Solar micro-inverters, and EV power. As background, in May 2023 EPC launched a lawsuit against Innoscience claiming infringement on EPC’s U.S. patent No. 8,350,294 (US‘294) plus 3 other U.S. patents (4 total patents). During the subsequent investigation, EPC withdrew two patents and the U.S. ITC ruled the third patent was not infringed. Subsequently, the US PTO (Patent and Trademark Office) issued a Final Ruling invalidating all 12 Claims in the US’294 patent, showing EPC’s allegations against Innoscience to be baseless.

Importantly, the LEO now only applies to legacy GaN chips, and it never affected customers’ power supplies which had incorporated those legacy GaN chips, when PCBA manufacturing is completed outside the U.S. and then imported into the U.S.

At present, both the ITC’s ruling and the USPTO’s final decision on US’294 patent are on Appeal. The LEO will be permanently rescinded after the U.S. Court of Appeals reverses the ITC’s determination or affirms the USPTO’s invalidity decision.

To clarify: as of February 20th, 2026, Innoscience may make, use, sell, offer for sale, and import its new-generation products directly into the U.S. without restriction. These new-generation products have an “AD” part number suffix.
