This announcement is made by InnoScience (Suzhou) Technology Holding Co., Ltd. (the“Company”, together with its subsidiaries, the “Group”) on a voluntary basis.
The board of directors of the Company (the “Board”) wishes to inform the shareholders and potential investors of the Company that the Company and its wholly-owned subsidiary, InnoScience (Suzhou) Semiconductor Co., Ltd. (英诺赛科(苏州)半导体有限公司), (“InnoScience Suzhou”, collectively the “Plaintiffs”) filed complaints ((2024) Su 05 Minchu No. 1430 (2024)苏05民初1430号) regarding patent number 202311774650.7 and ((2024) Su 05 Minchu No.1431 (2024)苏05民初1431号) regarding patent number 202211387983.X (collectively, the“Complaints”) with the Intermediate People’s Court of Suzhou City, Jiangsu Province, PRC against Infineon Technologies (China) Co., Ltd. (英飞凌科技(中国)有限公司) (“Defendant I”), Infineon Technologies (Wuxi) Co., Ltd. (英飞凌科技(无锡)有限公司) (“Defendant II”) and Suzhou Chipswork Electronics Technologies Co., Ltd. (苏州芯沃科电子科技有限公司)(“Defendant III”).
InnoScience Suzhou is the patentee of patent number 202311774650.7 and patent number 202211387983.X (the “Patents Involved”), for which the Company has obtained licenses from InnoScience Suzhou. Each of the Patents Involved relates to a gallium nitride (GaN) power device and preparation method thereof, and a nitride-based semiconductor device and method for manufacturing the same, respectively. According to the Complaints, Defendant II, a wholly-owned subsidiary of Defendant I, is the filing entity of Infineon’s Chinese website, which displays, advertises and offers for selling various models of gallium nitride (GaN) semiconductor devices (the “Infringing Products Involved”) to potential customers in the PRC. Defendant I is the importer and general distributor of the Infringing Products Involved. According to Infineon’s Chinese website, Defendant III is the value-added distributor of Defendant I and Defendant II in the PRC. After technical comparison, the Plaintiffs believe that the Infringing Products Involved fell within the scope of protection of the Patents Involved. The three defendants, without the Plaintiffs’ permission, implemented the offer for sale, sale and import of the Infringing Products Involved, which constituted infringement of the Patents Involved, and shall bear the corresponding legal responsibilities in accordance with the laws, including ceasing infringement and assuming the liability for compensation.
In order to protect their legitimate rights and interests, the Plaintiffs have initiated the subject lawsuits with the court in accordance with the law. The Company is of the view that the initiation of the abovementioned lawsuits will not adversely affect the normal business or operations of the Group. The Group will continue to actively seek legal advice and take appropriate actions as and when necessary, so as to safeguard the interests of the Group and its shareholders and to minimize any negative impact on the Group. The Company will make further announcement(s) in due course to inform the shareholders of the progress of the aforesaid lawsuits.
Shareholders and potential investors of the Company are advised to exercise caution when dealing in the securities of the Company.
For ease of reference, the names of the PRC established companies or entities have been included in this announcement in both the Chinese and English languages, and in the event of any inconsistency, the Chinese version shall prevail.
